Terms & Agreement

In this Conditions:

 

“The Company” means Grout Pro-Tech LLP

 

“The Customer/ Owner/ Client" means the person or company who purchases the Services or Goods

 

“The Service” means any service Grout Pro-Tech LLP supplies to the Client under the Contract/ Agreement.

 

“The quotation” means the Company’s written quotation for the services or goods supply.

 

“the Agreement” means the contract for the provision of Service made between the Company and the Customer, including these Conditions

 

“The Goods/Materials” means any items, units, equipment, or other goods that Grout Pro-Tech LLP supplies to the Customer under or relating to an Agreement.

Covid-19 Measure

1.1 If the Owner or any house member is having a fever, flu, or cough please report to us immediately, and if existing owners please reschedule the project. This is to avoid any unnecessary spread of Covid-19 disease. 


1.2 It is the Owner's full responsibility, to be honest about his/her family's health status. Please report to any Grout Pro-Tech LLP employees if any of the house members are on Stay-Home Notice (SHN) or having close contact with a confirmed COVID-19 case by MOH. Grout Pro-Tech LLP employees will help you immediately to reschedule the project at no additional cost. Any hiding or misleading information will be the Owner's responsibility.

Warranty Disclaimer

2.1 Grout Pro-Tech LLP provides a warranty against workmanship commencing on the date of project completion.

Grout cement powder: 7 days.

Grout sealing services: 1 month.

Acrylic /Epoxy/ Hybrid grout services: 2 years.
Polyaspratic grout service: 3 years.

2.2 The warranty covers tiles to tiles grouting only. This covers defects in grouting materials and installation at no additional cost, such as transportation fee.

2.3 The Warranty does not cover tiles to any other component, for example, sanitary ware, furniture, piping, plastic, metal, silicon, marble, wood, etc. Should repair not be covered, Grout Pro-Tech LLP shall be compensated for transportation, labor, and other miscellaneous fees.

2.4 Every warranty claim will be investigated and scheduled for repair by Grout Pro-Tech LLP availability date, which often is 2 weeks to 1 month during the peak period (year-end).

2.5 Damages due to the user's or any third party's fault, reconfiguration, repair, willful constructional variations, modifications, and adjustments, the owner will be charged as repair work and transportation fee, and the warranty will be void based on the investigation result. 

 

2.6. If it is a service quality issue, the Grout Pro-Tech LLP will do a makeup service at no additional charge within the warranty period. However, if the service was rendered properly to BCA/ industry standard/ customer adjustments then Grout Pro-Tech LLP will expect full payment as per needed.

 

2.7 All warranty is covered for Grout Pro-Tech LLP employee service. Any purchase of Grout Pro-Tech LLP materials done by other Companies' employees is not covered by any warranty. Client are encourage to seek advise from the installer as all workmanship quality is different.

 

2.8 Should any contractor purchase Grout Pro-Tech LLP materials, the warranty period is covered for material quality and not for workmanship quality. Material warranty is 6 month from date of purchase, without use or opened.

2.9 We will strongly advise if waterproofing/ leaking or any defective issues are to be repaired by the Owner before the commencement of work. Should the Owner choose to proceed without resolving the issue, grouting work can still proceed but may incur additional charges, depend on additional duration, and NO WARRANTY for the affected area(s).

2.10 Rescheduling due to leaking and/or defective issues/tile replacement by the Owner part will incur additional charges for causes of prolonged work and the new rescheduling date and time will be determined and agreed, upon by both parties, according to Grout Pro-Tech LLP schedule.

2.11 Grout Pro-Tech LLP strongly advises all clients to read the full terms and conditions before engaging in any Grout Pro-Tech LLP services/purchases. Any use of The Service/ Purchases from Grout Pro-Tech LLP is on condition of The Client's acceptance and compliance with these terms.

2.12 By accessing The Service / Purchases, the client is bound by these Terms. If the Client disagrees with any part of the terms, the client may not access the service/purchases.

Quotation Validity period

3.1 Any quote is valid for one month. The months period commences from the date of the quotation. Quotations accepted after this period may require re-quoting. Any changes in work conditions may require re-quoting.

4

Compensation

4.1. In consideration for the work performed on the Project Job, the Client will pay the total sum of $SGD Total project cost, according to the listed project set forth above, and subject to modification on account of any change orders to the scope of work made by the Parties according to the terms of this Project Contract.

 

4.2 An initial deposit equal to 50% of the total project fee is due before the first scheduled on-site working day. The remaining balance is due immediately upon project completion. The Project Job will be deemed to be completed and accepted by the Client unless a written notice describing any deficiency is received by Grout Pro-Tech LLP within three (3) business days from the last date of the project scheduled. Any payment past that date will be subject to a $100 late fee within the first month.

Late payment fees will be charged at a rate of 1.5% of the total project billed per month for the 2nd month onwards.

 

4.3 For clients who are individuals, payment is due at the end of the service. The invoice will be sent to the client before the service date. At the end of the service, the client should either show our technicians the PayNow or Bank Transfer proof of payment for the invoiced amount or provide a cheque/cash for the amount specified on the invoice. Our technicians will take a photo of the payment as evidence they received it.


4.4  For clients who are corporations, the balance payment is due within 30 days of the service. Any payment past that date will be subject to a $100 late fee. Late payment fees will be charged at a rate of 1.5% of the total project billed per month for the 2nd month onwards.
 

4.5 Grout Pro-Tech LLP will reserve the right to stop work and keep the Project Job idle if deposits/ payments are not made to Grout Pro-Tech LLP. If the work is stopped for such reason for a period exceeding 3 stop days without due payments being made, the Client shall be deemed to be at fault and Grout Pro-Tech LLP may, at its option, make a final demand for all payments due and owing, and any additional expenditures for work performed, materials ordered or supplied, or any other loss sustained. If payment is not made within 5 working days thereafter, Grout Pro-Tech LLP will be entitled to all legal remedies for breach of this Project Contract and demand full project value/due.

4.6 Grout Pro-Tech LLP will reserve the right to terminate or suspend our service/ purchases/ contract immediately with or without any prior notice or liability for any reason whatsoever, including without limitation if the client breaches the terms.

Cancellation & Reschedule Policy

5.1 For all services provided by Grout Pro-Tech LLP, cancellation must be notified at least 7 days before the scheduled date for a full refund on the 50% deposit. For cancellations of less than 7 days, the 50% deposit will be non-refundable.

5.2 For all rescheduled due to COVID-19 with proof of positive, no additional charges are required.

5.3 For project rescheduling, please inform us 7 days before so we can keep the slot for other projects. If 2nd rescheduled within 7 days before the project starts, may incur a rescheduling fee of $100 before the GST. 

If rescheduled within 2 days before the project starts, may incur a rescheduling fee of SGD $100 before the GST.

Change Order

6.1 From time to time during the performance of work under this Construction Contract, there may be changes required or requested to the scope of work, price, and time for completion, under this Construction Contract. All such proposed changes will be submitted to the other Party in writing containing at least the following information: proposal date, the change requested, explanation of how that will affect the cost or time of completion, and signed by the proposing party. When both parties have signed to acknowledge their approval of such a proposal, it will be designated as a “Change Order” and will then be incorporated into this Construction Contract and is binding on both parties.

 

6.2 For all services provided by Grout Pro-Tech LLP, any schedule changes must be notified at least 7 days ahead and reschedule limits capped at 2 times. In the event the new session is eventually cancelled, then the cancellation fee outlined above will apply instead.

 

6.3 The Grout colour must be confirmed before the project's scheduled date. Once the colour has been confirmed, it will not be able to change during or after the project. If the client/ owner insists that the confirmed colour needs to be changed, Grout Pro-Tech LLP will have to charge for the redo and the project will be rescheduled before Grout Pro-Tech LLP's availability.

Liabilities & Quality Control

7.1 Grout Pro-Tech LLP provides for Work Injury Compensation for all its workers as laid out in the Work Injury Compensation Act (WICA), and Medical Insurance.

 

7.2 Grout Pro-Tech LLP liabilities for all other loss or damage suffered by the Client in any one month and caused by an act or omission of Grout Pro-Tech LLP, its employees shall not exceed either 100% of the value of the appointment in which damage was caused or $1000, whichever value is lower.

 

7.3 Grout Pro-Tech LLP shall not be liable in any way for any loss of profits, nor shall it be liable for any indirect, consequential, or special loss or damage howsoever caused and arising from the Client’s use or possession of the Goods or benefit from the services provided by Grout Pro-Tech LLP.

 

7.4 If the Client will pay for any damaged or missing equipment arising out of the Client's property in such employees' tools or taking equipment that belongs to Grout Pro-Tech LLP.

 

7.5 Grout Pro-Tech LLP is allowed to display the Client service area as part of its client portfolio/marketing purposes, progress documentation, and warranty.

7.6 The Client's use of the service is at its own sole risk. The service is provided on an "As is" or "As available" basis. The client should not expect dirt/mold to not sit on newly laid grout but rather premium material to inhibit the absorption of dirt/ mold. Should a repair be scheduled based on the above issue, Grout Pro-tech LLP will be compensated for an investigation fee of SGD$100 before GST per visit. 

8

Additional Provisions

8.1 Grout Pro-Tech LLP will perform services based on a schedule mutually agreed upon by both parties. Standard operations are from Monday to Friday between 0900 and 1700, excluding public holidays. Additional charges will be incurred for services requested beyond standard operations timings.

 

8.2 The Client must provide Grout Pro-Tech LLP with access on the scheduled dates. If the installation team arrives at the scheduled time and is unable to access the work area, a SGD $100 before the GST rescheduling fee will be applied.​ 

 

8.3 The Client will provide Grout Pro-Tech LLP, and its employees, agents, and subcontractors, reasonable access to the Property for purposes of conducting work on the Construction Project. 

 

8.4 The Client will obtain, at its own cost, all necessary permits and permissions to perform the work required for the Construction Project. Should permit or Grout Pro-Tech be rejected access area on the scheduled date for whatsoever reason, a rescheduling fee will be applied.

 

8.5 If the Service involves a bathroom / wet area, The Client  must make sure the area is left dry overnight (minimum of 6 hours). If the area is wet and Grout Pro-Tech LLP is unable to start work, Grout Pro-Tech LLP reserves the right to reschedule the project and an SGD $100  before the GST rescheduling fee will be applied.​ 

 

8.6 The client is responsible for providing electricity during the project, and for ensuring that other contractors, family members, children, and pets do not interfere with the project’s progress.

 

8.7 During the course of work on the Construction Project, The Client or the Owner’s designated agent, will have access to the Property for purposes of inspection, appraisal, and work evaluation. Such access and inspections will be conducted at reasonable times, with advance notice to Grout Pro-Tech LLP when reasonably practicable, and in a manner not to obstruct the progress of construction. If any interference happens, Grout Pro-Tech LLP will have the right to stop all works immediately, and an SGD $100 before the GST rescheduling fee will be applied.

 

8.8 Grout Pro-Tech LLP will not be deemed in breach of this Construction Contract or have liability to the Client for failure to perform obligations under this Project Contract if the failure is due in whole or in substantial part to strikes, acts of God, unavailability of specified labor or materials, war, acts of terror, or other causes beyond the reasonable control of Grout Pro-Tech LLP. 

 

8.9 At the handover of the project, the Owner/ Client or an individual over 18 years old representative of the owner must be present to have a round of site walk with the Grout Pro-Tech LLP representative. Should The Client/Owner choose not to be present on the last date of the project for handover, it will be deemed as default completed. Once the project is completed, it is considered closed and the date will be the date of project completion.

9

Project Contract

9.1 Construction Project shall mean the work that Grout Pro-Tech LLP is obligated to perform for the Owner as detailed on the Project Contract form or invoice stated.

9.2 Grout Pro-Tech LLP reserves the right to modify or change the terms without any prior notice. If any provision of these terms is held to be invalid or unenforceable by the court, the remaining terms shall remain in effect. 

9.3 If the Client does not agree with these terms at any point in time, please stop using the service. This does not cover the invoice /payment due amount and the Client will be billed as per the project closed. 

9.4 If the Client / Owner has any questions regarding these terms, please contact us before engaging in the service/purchase. 

10

Jurisdiction

10.1 This Agreement and these Terms shall be construed by Singapore Law and shall be subject to the exclusive jurisdiction of the courts of Singapore.

 

10.2 Grout Pro-Tech LLP strongly advises all customers to read carefully the full terms and conditions before engaging with any Grout Pro-Tech LLP services/purchase.

In any wistful event, customers shall bear full responsibility or cost.
